વ્યાખ્યા : જે કોઈ વ્યક્તિ ગુનાહિત વિશ્વાસઘાત કરે તેને ત્રણ વર્ષ સુધીની બે માથી કોઈપણ પ્રકારની કેદની અથવા દંડની અથવા બંને સજા થઈ શકે છે.

Section 406 of IPC - Punishment for criminal breach of trust

Definition: Whoever commits criminal breach of trust shall be punished with imprisonment for a term which may extend to three years or with fine or with both.

Classification of Offence:

Imprisonment up to 3 years or with fine or with both - Police authority - Non-bailable - Magistrate of the first class

Example:

1. A cashier (Mr. X) working in a company is entrusted with ₹5,00,000 to deposit in a bank.

Instead of depositing it, Mr. X uses the money to pay off his personal debts.

 

2. Mrs. Y gives gold worth ₹2 lakh to Mr. Z, a jeweller, to make a necklace.

Instead, Mr. Z sells the gold and keeps the money.

 

3. A, a real estate agent, is given the authority to rent out B's house.

Instead, A sells the house and keeps the money.
